PerfectPick AI - Terms of Use

a. Scope of License:
The Licensor, PerfectPick AI, grants you a nontransferable license to use the Licensed Application on Apple-branded devices that you own or control and as permitted by the App Store Usage Rules. This license governs the use of PerfectPick AI, including any updates provided by the Licensor. You may not distribute, transfer, sublicense, or make the Licensed Application available over a network where it could be used on multiple devices simultaneously. Furthermore, you may not copy, reverse-engineer, disassemble, modify, or create derivative works of the Licensed Application unless explicitly allowed by law.

b. Consent to Use of Data:
PerfectPick AI does not collect, store, or process personal user data. The application operates solely on the data you provide locally on your device. No third-party services are integrated, and no information is transmitted outside the app.

c. Termination:
This agreement is effective until terminated by you or the Licensor. Your rights under this agreement will terminate automatically if you fail to comply with any of its terms.

d. External Services:
PerfectPick AI does not integrate or provide access to third-party services or websites.

e. NO WARRANTY:
YOU ACKNOWLEDGE AND AGREE THAT PERFECTPICK AI IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE LICENSOR SHALL CREATE ANY WARRANTY.

f. Limitation of Liability:
TO THE EXTENT NOT PROHIBITED BY LAW, PERFECTPICK AI SHALL NOT BE LIABLE FOR INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. THE TOTAL LIABILITY OF THE LICENSOR SHALL NOT EXCEED FIFTY DOLLARS ($50.00).

g. Export Compliance:
You agree not to export or re-export the Licensed Application to any country or individual prohibited by U.S. law. By using the application, you confirm that you are not located in such countries or on restricted lists.

h. Governing Law:
This agreement shall be governed by the laws of the State of California, excluding conflict-of-law provisions. Any disputes shall be resolved in courts located in Santa Clara County, California, unless you are a resident of the European Union, Switzerland, Norway, or Iceland, in which case local laws and courts apply.

i. Subscription Billing and Cancellation:
If you purchase any subscriptions, billing will occur automatically via Apple after your trial period ends. You can cancel anytime before your renewal date through your Apple subscription settings. To avoid charges, cancel your plan at least 24 hours before the next billing cycle.

j. Prohibited Use:
Using PerfectPick AI to discriminate, harm, or engage in illegal activities is strictly prohibited.
